Abstract
The present article of reflection intends to make an approach to the effects of the residence and work authorization, for the realization of any lucrative, labor or professional activity in Spain. For this particular, the characteristics that include the irregular worker, the development of the Constitutional Court and the analysis of the Court of Justice of the European Union are exposed. Finally, the crime against the rights of workers is studied, hoping to show a globality of what the rights of the worker in an irregular situation imply.
