Abstract
Many questions arise about the issues of immigrates and immigration: specifically, sociological, political, economic and legal issues. This work will be dedicated to the legal regulation of irregular (illegal) immigrates and legal immigrates in respect to the right of health care. We start from a brief international, European and constitutional considerations to analyze the situation created by the approval of Royal Decree-Law 16/2012 of April 20. We also look at the modification that this has entailed in the health care of non-EU citizens to receive health care. The main objective of this work is to analyze the health care within the framework of the International and European framework, and the Spanish National Health System framework. Specifically, the situation of immigrates in general and illegal immigrates in particular. This work has been designed with a methodological strategy based on documentary scientific-legal research, following the deductive method, using legal sources, starting from the international norms, the 1978 Spanish Constitution and the norms of development, Jurisprudence emanating from the Courts of Justice, and the Scientific Doctrine, highlighting the particularity that this issue is addressed in the Spanish system, both by the labor doctrine and administration, as a specific manifestation of the unique position of health care in Spain. Which on the one hand, constitutes a provision of a public service and, on the other hand, a provision of the system of professional social security.
