Abstract
The article aims to analyze the art. 311. Bis a) of the Spanish Penal Code, evidencing the connotations that this has with reference to immigrant workers, since the criminal type could configure a social conflict, as soon as people who offer work to irregular immigrants are penalized; On the other hand, employers offer these jobs, in order to help immigrants to survive with dignity, taking into account that most of them, the irregular quality is due to delays of the same public administration of the State in the renewal processes of work permits, leaving these people in a defenseless condition.
